Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the Wishmeal platform and all related services (“Services”). By accessing or using Wishmeal, you agree to be bound by these Terms. If you do not agree, please do not use our Services.

References to “Wishmeal”, “we”, “us”, or “our” refer to the Wishmeal platform and its operators. “You” or “Creator” refers to any individual or entity that accesses the Services.

1. Scope of Services

Wishmeal provides a platform for recipe creators to grow their audience and engage their followers. Our Services include, but are not limited to:

• Automated Instagram DM responses triggered by keyword comments
• WhatsApp Channel growth tools that allow followers to save recipes directly to WhatsApp
• Automated generation of recipe webpages from your Instagram content
• Analytics and engagement reporting

To use the Services, you may be required to connect your Instagram account and grant Wishmeal the necessary permissions to act on your behalf within the bounds of Instagram's Platform Policies.

2. Eligibility and Account

You must be at least 18 years of age to use Wishmeal. By using the Services, you represent that you are 18 or older and have the legal capacity to enter into these Terms.

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately at support@wishmeal.app if you suspect unauthorised access.

3. Proprietary Rights and Licence

Wishmeal owns all intellectual property rights in the platform, software, and Services. Nothing in these Terms transfers any ownership rights to you.

We grant you a limited, non-exclusive, non-transferable, revocable licence to access and use the Services for your personal or business purposes as a recipe creator, subject to these Terms.

You may not:

• Copy, modify, or create derivative works of the platform or its software
• Reverse-engineer, decompile, or attempt to extract the source code
• Use the Services to build a competing product
• Resell or sublicense access to the Services

You retain ownership of all content you create and share. By connecting your Instagram account, you grant Wishmeal a limited licence to access and use your content solely to provide the Services.

4. Pricing and Payments

Wishmeal offers both free and paid plans. The features available under each plan are described on our website and may be updated from time to time.

• Free Plan: Available at no cost with limited features, as described on the pricing page.
• Paid Plans: Billed monthly or annually, as selected at the time of purchase. Subscriptions automatically renew unless cancelled at least 24 hours before the renewal date.
• Price changes: We will provide at least 10 days' advance notice before changing the price of your current plan.
• Refunds: All fees are non-refundable unless required by applicable law.

All payments are processed in Indian Rupees (INR) unless otherwise stated. Applicable taxes will be added at checkout.

5. Acceptable Use

You agree to use Wishmeal only for lawful purposes and in accordance with these Terms. You must not:

• Violate Instagram's Platform Policies or WhatsApp's Terms of Service while using Wishmeal
• Use the Services to send spam, unsolicited messages, or misleading content
• Impersonate any person or entity
• Upload or transmit any content that is unlawful, harmful, or infringes third-party rights
• Attempt to gain unauthorised access to Wishmeal's systems or data

We reserve the right to suspend or terminate your account if we determine, in our sole discretion, that you have violated these Terms.

6. Term and Termination

These Terms are effective from the date you first access the Services and continue until terminated.

• By you: You may terminate your account at any time by contacting support@wishmeal.app. Termination does not entitle you to a refund of any prepaid fees.
• By Wishmeal: We may suspend or terminate your access at any time, with or without notice, for any reason including violation of these Terms.
• Inactive free accounts: Free accounts that have had no activity for 12 consecutive months may be automatically deactivated.

Upon termination, your right to use the Services immediately ceases. We may retain certain data as required by law or for legitimate business purposes.

7. Disclaimer of Warranties

The Services are provided “as is” and “as available” without warranties of any kind, express or implied. We do not warrant that the Services will be uninterrupted, error-free, or free of viruses or other harmful components. We do not guarantee any specific results from using our engagement or growth tools.

8. Limitation of Liability

To the maximum extent permitted by applicable law, Wishmeal's total liability to you for any claims arising out of or relating to these Terms or the Services shall not exceed the fees you paid to Wishmeal in the six (6) months immediately preceding the claim, or ₹500, whichever is greater.

In no event shall Wishmeal be liable for any indirect, incidental, consequential, special, or punitive damages, including loss of profits, data, or business opportunities, even if we have been advised of the possibility of such damages.

9. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of India. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in India.

Before initiating any legal proceedings, both parties agree to attempt to resolve the dispute amicably by notifying the other party in writing and allowing 30 days to resolve the matter.

10. Changes to These Terms

We may update these Terms from time to time. When we do, we will update the “Last updated” date at the top of this page and, where appropriate, notify you by email. Your continued use of the Services after any changes constitutes acceptance of the updated Terms.
